The fine print
The terms you agree to when you buy from Summit Au. Written to be read, not to be impenetrable.
This site is operated by [Registered company name], ABN [XX XXX XXX XXX], of [registered address], trading as Summit Au. “We”, “us” and “our” mean that entity.
Placing an order is an offer to buy. A contract forms when we dispatch the goods, not when you receive an order confirmation. We may decline or cancel an order — for example where an item is out of stock, a price is obviously wrong, or we suspect fraud — and if we do, we refund you in full.
Prices are in Australian dollars and [include/exclude] GST. Prices can change without notice, but never after you have placed an order. If a pricing error is obvious and material, we will contact you before dispatch rather than silently shipping or cancelling.
Climbing, mountaineering and alpine travel are inherently dangerous and can result in serious injury or death. Our equipment reduces some risks; it does not remove them. You are responsible for being trained in the correct use of any equipment you buy, for inspecting it before every use, and for retiring it when it is due. Nothing we publish is a substitute for instruction from a qualified person.
The content of this site — text, photographs, the Summit Au name and marks — belongs to us or our licensors. You may not reproduce it commercially without written permission.
Keep your password to yourself and tell us promptly if you think someone else has it. You are responsible for activity on your account.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our liability for a breach of a non-excludable guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
These terms are governed by the laws of [State/Territory], Australia, and you and we submit to the courts of that jurisdiction.
We may update these terms. The version that applies to your order is the version published when you placed it.
Note for the site owner: this page is a solid starting structure, not legal advice. Have it reviewed by an Australian lawyer before you begin trading.
